Terms of Service

Plain-English summary: GeoGear Tools helps surveying professionals do their job faster. We're not a licensed surveying firm, and our outputs aren't a substitute for a licensed Professional Land Surveyor's work. You agree to use the tools honestly, not to abuse them, and to verify outputs before relying on them in legal or construction contexts.

1. Who we are

GeoGear Tools ("the Service") is operated by GeoGear Supply LLC, a Michigan limited liability company ("GeoGear", "we", "our", "us"). By creating an account or using the Service, you ("Customer", "you") agree to these Terms.

2. Nature of the Service

GeoGear Tools are professional aids and do not constitute licensed surveying services. All outputs — including but not limited to parsed legal descriptions, zoning setback lookups, plotted linework, and point lists — should be verified by a licensed Professional Land Surveyor before use in legal, construction, or boundary determination contexts.

Zoning setback data is sourced from publicly available municipal ordinances and may not reflect recent amendments, variances, or special conditions. Always verify with the local building/planning department.

3. Accounts

You must be at least 18 years old to create an account. You're responsible for keeping your password confidential and for all activity that happens under your account. Tell us immediately if you suspect unauthorized use.

4. Acceptable use

Don't attempt to reverse-engineer, scrape, or otherwise access the Service except through the provided interfaces.
Don't upload data containing malware, illegally obtained personal data, or content that violates someone else's rights.
Don't use the Service to build a competing product, train a competing AI model, or aggregate data about other customers.
Don't use automated traffic to bypass rate limits or credit charges.

5. Payments and refunds

Credits

Credits are purchased in packs (Starter, Standard, Pro) and stored in your account indefinitely until used. Unused credits are non-refundable but are transferable to other tool usage inside your account.

If an AI-powered operation fails due to a server error, timeout, or similar issue on our end, charged credits are automatically refunded.

Subscriptions

Seat licenses (Field, Office, Enterprise) are billed monthly through Stripe. Cancellation takes effect at the end of the current billing period. Your data is retained for 90 days after cancellation in case you change your mind, then permanently deleted.

We offer a 14-day free trial on all seat tiers. If no payment method is added by the end of the trial, the account is automatically downgraded to the free tier (COGO Calculator and Coordinate Converter only).

6. Intellectual property

GeoGear retains all rights in the Service, its UI, source code, and models. You retain ownership of all data you upload. By uploading, you grant us a limited license to process, transform, store, and return that data as needed to deliver the Service.

With your explicit opt-in consent, GeoGear may use anonymized, de-identified versions of your description key mappings, code lists, and linework conventions to improve the AI. See our Privacy Policy for details.

7. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that outputs will be accurate, complete, or suitable for any particular purpose.

8. Limitation of liability

To the fullest extent permitted by law, GeoGear's total cumulative liability arising out of or relating to the Service shall not exceed the greater of (a) $100 USD or (b) the fees you paid to GeoGear in the twelve months preceding the claim. In no event shall GeoGear be liable for indirect, incidental, consequential, special, or punitive damages.

9. Termination

We may suspend or terminate your account for material breach of these Terms, suspected fraud, or extended non-payment. You may terminate at any time from the billing portal. Upon termination, access to the Service ends and your data enters the 90-day retention window described above.

10. Governing law and dispute resolution

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-laws principles. Any dispute shall be resolved in the state or federal courts located in Oakland County, Michigan, and you consent to the exclusive jurisdiction of those courts.

11. Changes to these Terms

We may update these Terms occasionally. Material changes will be announced by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
